1. SCOPE

These General Terms and Conditions of Sale (T&Cs) govern all sales of products offered on the website:

Placing an order implies unreserved acceptance of these T&Cs.


2. PRODUCTS

The products offered are those shown on the website, while stocks last.

The clothing offered is, for the most part, branded in France and imported through specialised distributors.

Visuals and descriptions are provided for guidance only. Minor variations may exist (colour, cut, finish).

MS Motors reserves the right to modify or withdraw a product without notice.


3. PRICES

Prices are shown in euros (€), all taxes included.

Shipping costs are specified before the order is confirmed.

MS Motors may change its prices at any time. The applicable price is the one confirmed at the time of the order.

In the event of an obvious pricing error, the order may be cancelled.


4. ORDERS

The customer selects the products and confirms the order after accepting the T&Cs.

The order becomes final after:

  • full payment

  • confirmation by email

MS Motors reserves the right to refuse or cancel any order that is:

  • fraudulent

  • suspicious

  • linked to a previous dispute

  • inconsistent in the information provided


5. PAYMENT

Payment is due immediately.

Accepted methods: bank card, bank transfer or any other method offered on the website.

Payments are secured (PCI DSS standards).

In the event of a declined payment or payment incident:

  • the order is cancelled

  • the associated contest entries are invalidated


6. DELIVERY

Products are delivered to the address provided by the customer.

Delivery times are indicative.

MS Motors cannot be held liable for:

  • carrier delays

  • customs holds

  • events beyond its control

Risk transfers when the package is handed over to the carrier.

In the event of a problem (damaged or incomplete package), the customer must report it within 48 hours to:

7. RIGHT OF WITHDRAWAL

In accordance with the law, the customer has 14 days to exercise their right of withdrawal.

Return conditions:

  • complete product

  • unworn

  • unwashed

  • original packaging

Return shipping costs are borne by the customer.

Refund within 14 days of receipt.


8. LINK WITH THE PRIZE DRAW

Purchasing a product may grant entries in the prize draw organised by MS Motors.

These entries are:

  • validated only after effective payment

  • cancelled in the event of a refund, fraud or payment dispute

The full terms are set out in the contest rules available on the website.

The T&Cs and the contest rules are complementary and inseparable.


9. LEGAL WARRANTIES

The products benefit from:

  • the legal warranty of conformity

  • the warranty against hidden defects

Duration: 2 years from delivery.

  • failing that: exclusive jurisdiction of the courts of Nice


15. FINAL PROVISIONS

If any clause is invalid, the remaining clauses remain applicable.

Failure to enforce a clause does not constitute a waiver.
